Any pricing, square-footage ranges, timelines, or estimates shown on this Site are provided for general informational purposes only and are based on typical project conditions in the Seguin, TX area. They are not a binding offer or a contract price. A final, written quote is provided only after an on-site evaluation of your specific property, soil conditions, access, and project scope. Written quotes are valid for thirty (30) days from the date issued unless otherwise stated.

3. Project Agreements

A concrete, foundation, metal building, or material delivery project is governed by a separate written contract signed by both you and Top Notch Concrete. That contract — not these Terms — controls the scope of work, materials, schedule, payment, and warranty for your project. In the event of any conflict between these Terms and your project contract, the project contract controls.

4. Site Conditions & Access

You are responsible for providing safe, reasonable access to the work area, including clear obstructions, utility line locations, and any permits required for the work. You agree to disclose known soil issues, buried utilities, easements, or site conditions that could affect the project. Top Notch Concrete is not responsible for delays or additional costs caused by undisclosed site conditions, failed inspections by third parties, or acts of nature.

5. Payment Terms

Unless otherwise agreed in your written contract, a deposit may be required to schedule work, with the balance due upon project completion. Deposits are generally non-refundable once materials or scheduling have been committed. Accepted payment methods include cash, check, and credit/debit card. Late payments may be subject to additional charges as permitted by Texas law.

6. Warranties and Disclaimers

Top Notch Concrete warrants its workmanship to the extent stated in your written project contract. Concrete is a natural material subject to environmental conditions; minor cracking, color variation, and surface curing are normal and are not considered defects. Except as expressly stated in a written contract, all services and content on this Site are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

7. Limitation of Liability

To the maximum extent permitted by law, Top Notch Concrete LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Site or our services, even if advised of the possibility of such damages. Our total liability for any claim arising out of this Site is limited to the amount you paid for the related service, if any.
